  1. INTRODUCTION

 

At Access Scholarships and its subsidiaries and affiliates, including any successor entities if we rebrand our business under a different name (collectively, “we”, “our”, or “us”), we care about the privacy and security of your information. This Privacy Policy (this “Privacy Policy”) contains details about how we collect, use, store, disclose and otherwise process certain information, including your personal information. Access Scholarships may also be referenced as “Education Services”.

 

This Privacy Policy applies to information we collect and process, including information regarding:

 

Our “Services”, which include our: (i) online services, platforms, websites or mobile applications (collectively, “Sites”); (ii) co-branded web pages, mobile applications or websites; (iii) advertising services; (iv) emails or newsletters we sponsor or send; (v) contests, sweepstakes, promotions, events, research and surveys that we sponsor or conduct; (vi) accounts on third-party social networking sites; and, (vii) other content, products and services that we make available to consumers, customers, subscribers, and/or users (collectively, “Users”).

Individuals who subscribe to receive news, information, and marketing communications from us.

Individuals who engage with us at conferences, expos, and other events in which we participate.

Users and other individuals that communicate or engage with us related to our Services.

“Services” also include any interactive features, widgets, plug-ins, applications, content, downloads and/or other online or offline services that we own and control (including those made available through a Site), and in each case wherever this Privacy Policy is posted. This Privacy Policy describes the privacy practices of our Services (as defined in our Terms of Use), and anywhere we display or reference this Privacy Policy.

 

Not Covered by This Privacy Policy

This Privacy Policy does not apply to any third-party websites, services, products or mobile applications maintained by other companies or entities, which may be linked from our Sites or Services. This Privacy Policy generally applies to our processing of the personal information of all other individuals.

 

Aggregate and Non-identifiable Information

Notwithstanding anything else in this Privacy Policy, we may collect, use, share, disclose, and otherwise process aggregate, anonymous, and in some cases de-identified information for research, marketing, analytics, and other purposes. Where we use, disclose or process de-identified information, we will maintain and use this information in de-identified form and not to attempt to reidentify the information, except in accordance with applicable privacy laws.

 

  1. SOURCES OF PERSONAL INFORMATION

 

In this Privacy Policy, the term “personal information” refers to information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, as well as to information defined as “personal information,” “personal data,” “personally identifiable information,” and other similar terms under applicable privacy laws.

 

You can visit our Sites and use certain Services without registering. However, in certain circumstances (e.g., to create an account or use certain Services), you must provide us with certain personal information. The personal information that we collect varies depending upon your use of our Services and our interactions with you.

 

We have access to/collect Personal Information:

Directly From You. We may collect information directly from you in connection with an application for our scholarship sweepstakes (the “Scholarship”) offered on the Service, via the Service’s contact page, scholarship database, email, or other direct contact from you. For example, to access and use certain Services (e.g., to create an account, submit an inquiry, or apply for a Scholarship), we may require you to provide us with certain information including your name, username and password, as well as location, birthdate, phone number, email, and other contact information. If you decline to register and provide the mandatory information, you may not be able to use certain Services. We may also ask you or allow you to submit certain optional information, which may preferences, demographic, or other profile information. Other ways we may collect information directly from you include interactions with our college planning and scholarship tools, scholarship applications, marketing, promotions, your communications to us, registration and profile information, shipping information, other contact information, information you provide about others, uploaded files or content, comments, reviews, feedback, sweepstakes, Sites, and and calls to our call center.

Indirectly From You. For example, your activity with our Services; your interactions with our emails and texts; device IDs or other unique identifiers, including from your network devices (such as IP address, or router information); resettable device identifiers (also known as advertising identifiers); device and software characteristics; information collected via the use of cookies, web beacons, clear GIFs, pixel tags, log files, local shared objects, java script, and other technologies, including ad information; vendors and service providers; analytics tools, and third party tools. More is described in Section 6 below, such as our use of cookies and other tracking technologies to collect information about you, your device, and your use of the Services.

From Our Affiliates and Related Entities. For example, companies or affiliates (financial and nonfinancial) under common ownership or control with us, or other related entities.

From Business Partners. For example, we may collect and receive personal information from current, former and prospective vendors, business partners, and others with whom we have a business relationship.

From Vendors. We may engage vendors and work with other partners to provide services to us or to Users on our behalf (for example, cloud hosting and service providers). In addition, we may receive personal information from ad networks, analytics providers, and others who we work with to deliver, improve, and measure our online advertising and marketing campaigns. Additional vendors can be software providers, Third-Party Digital Businesses and other marketing companies, communication services, fraud prevention services, data analytics providers, data providers.

Third Parties that you directed to disclose personal information to us. For example, advertisers, educational institutions, financial institutions, lenders, and retailers.

Third Party information and marketing partners. For example, partners from whom we buy, lease, or otherwise obtain lists for marketing purposes.

Government or public sources. For example, publicly-available data sources.

Other parties. We may receive information about you from parent/guardians submitting information on your behalf and through our business partners including other third parties, such as, third parties who distribute or promote the Services; third parties whose services are available through the Services or Sites; data providers, ad networks and other advertising partners; advertisers that show ads or content through our advertising services may also provide data about individuals to us to personalize and measure ads through our advertising services; service providers and vendors (e.g., ad fraud vendors that provide IP addresses to help us identify potentially suspicious activities); if you enter one of our sweepstakes or contests hosted on a third-party platform, we will receive information about you and the information you provide to enter.

 

  1. WHAT PERSONAL INFORMATION DO WE COLLECT?

 

The categories of Personal Information we may collect are outlined below:

Category of Personal Information

Identifiers and contact information (such as name, user name, alias, phone number, address, email address, social security number, IP address, or cookie ID, BUID, device ID, third-party platform identifiers and other online or unique identifiers).

  • Personal Records (such as account and profile information, and customer records that contain personal information, employment, employment history, such as name, address, telephone number, year in school, education).
  • Personal Characteristics or Traits (such as age, marital status, sex, sexual orientation, veteran or military status, racial or ethnic origin, religious or philosophical beliefs, union membership or genetics data)
  • Transaction / Commercial Information (such as products or services used, purchased, or considered; Third-Party Partners’ or Third-Party Digital Businesses’ products or services considered; and other purchasing or consuming histories or tendencies provided by business and marketing Vendors)
  • Usage Data (such as browsing history, clickstream data, search history, access logs, information regarding your interactions with Sites and Services and our marketing emails, newsletters, and online ads, and other usage data related to your use of the Services, such as language and preferences, statistics, click paths, preferences and friends, as well as your comments, posts, and interactions in any forums and communities).
  • Geolocation Data (such as when you enable location-based features on your device, when we may infer your rough location (such as zip code) as part of the Sites, and location information about a particular individual or device, such as device location information for mobile Users).
  • Audiovisual and Similar Information (such as audio, electronic, visual, or similar information, photographs and images (e.g., that you provide us or post to your profile), call recordings (e.g., of customer support calls), and User photos submitted (such as profile images)).
  • Professional or Employment Information (such as your title, affiliated organization, professional expertise and experience, and education related information)
  • Inferences from Personal Information Collected (such as information we collect about you that we combine and use to derive other information and inferences about you. This includes inferences drawn from other personal information that we collect to create a profile based on your account and activities, that reflect your preferences, characteristics, behavior, attitude, and abilities related to the Services and Sites).
  • Account information and password (we may store your account log-in in combination with a password in our systems.)
  • Sensitive Information (such as government-issued identification numbers, account information and passwords, information regarding race, ethnicity, precise geolocation and religious affiliation that you voluntarily provide when you utilize our education products and services, and information regarding an individual’s health).

 

  1. HOW DO WE USE YOUR PERSONAL INFORMATION?

 

We may use your personal information for any of the following purposes:

  • Processing transactions and providing our products and services – to process transactions, service accounts and provide you with information or services or to perform activities that you have requested or information you agreed to receive, or to provide you with special offers or materials on behalf of us or certain third parties (collectively, “Third-Party Partners”) that may be of interest to you.
  • Support, Maintenance and Fulfillment. We use your information to provide and maintain the Services and Sites, and to process and fulfill your requests or applications.
  • Vendors and Providers - We may engage vendors, agents, service providers, and affiliated entities to provide services to us or to Users on our behalf, such as support for the internal operations of our Sites and Services (e.g., operations and technical support processing), as well as related offline product support services, data storage, and other services. In providing their services, they may access, receive, maintain, or otherwise process personal information on our behalf.
  • Facilitating your relationship with our Third-Party Partners – to provide services and facilitate marketing of products and services provided by third parties, we may disclose your personal information to Third-Party Partners so that they can market products and services that we believe you may be interested in. These Third-Party Partners may include scholarship providers, financial services providers, and companies in the consumer service industry.
  • Customizing your experience, offers, and content – to enhance your experience on our Sites and the products and services we offer, you may be delivered curated content on our Sites, including marketing for our own products or service offerings, our affiliates’ products or service offerings, or those of our Third-Party Partners.
  • Registering and administering accounts – to process your registration with the Sites, verify your information is active and valid, and to manage your account.
  • Customer service and communications – to respond to questions, comments, or requests that you have for us or for other customer service purposes; to contact you with regard to your use of the Sites and, in our discretion, changes to the Sites and/or Sites’ policies; and to verify eligibility for certain services offered by us or our Third-Party Partners. We use your information to communicate with you, including sending you service information such as confirmations, invoices, notices, updates, security alerts, user surveys, and support and administrative messages.
  • Research, development, and analytics – for beta testing our Services or to better understand how users access and use our Sites, both on an aggregated and individualized basis, in order to improve our Sites and respond to user desires and preferences, and for other research and analytical purposes. We use your information to measure performance and analyze key metrics relevant to our business and Services.
  • Ad measurement, attribution, and other ad administration – to assist us in determining relevant advertising and to determine the success of our advertising campaigns and to help us determine where to place our ads, including ads placed on other websites. These activities may be carried out by us, our vendors that perform services for us, including “service providers” and “processors,” as those terms are defined under applicable privacy laws (collectively, “Vendors”), and/or tech companies that offer digital advertising services (collectively, “Third-Party Digital Businesses”).
  • Market research and customer satisfaction – to administer surveys and questionnaires, such as for market research or customer satisfaction purposes.
  • Personalization –to personalize your experience on the Services, including suggesting and offering you relevant content and recommendations.
  • Advertising services - We use your information to show you ads (including personalized ads) through the Services, and on third-party websites, mobile apps, platforms and devices. We use your information to measure and understand the reach, viewership, and effectiveness of advertising, and to provide advertising analytics and reporting. We also help advertisers and advertising partners reach the desired audience and understand, measure and improve their ad campaigns. We use your information to reach you with more relevant ads and to evaluate, measure, and improve the effectiveness of our ad campaigns; to send you newsletters, offers, or other information we think may interest you; to contact you about our Services or information we think may interest you; and to administer promotions and contests.
  • Marketing and Promotions - We use your information for marketing purposes, including to send you alerts, notifications, emails and text messages, about products, events, promotions and offers from us or our partners, and to measure and understand the effectiveness of our marketing, or to communicate directly with you now or in the future, including, without limitation, by sending you emails containing content from our blog and information about promotions, and products and services that may be of interest to you, including third-party promotions, and third-party products and services (collectively, “Marketing Communications”).
  • Safety, security, and compliance with legal obligations – for identity verification, prevention, detection, investigation, and mitigation of illegal or unauthorized activities, fraud, injury to us, our Users or others, or violation of our Terms of Use or this Privacy Policy (including click fraud), as well as to fulfill contractual, legal and regulatory requirements.
  • Disclosed purposes– for purposes disclosed at the time you provide your personal information.
  • Additional compatible purposes – for purposes that are compatible with the purpose of collecting your personal information and that are not prohibited by law, including for our legitimate business interests such as in protecting, maintaining, and improving the Services; developing new features and services; and marketing and promoting our Services (including by profiling and marketing to Users).
  • Improvement of products and Services – to understand and analyze our User base and how you use the Services, to improve and enhance the Services (including building correlations for use in our advertising services in order to better serve our advertisers and business partners), and to develop new products, services, features and functionalities.
  • Auditing, reporting, corporate governance, and internal operations –for financial, tax, and accounting audits; audits and assessments of our operations, privacy, security and financial controls, risk, and compliance with legal obligations; our general business, accounting, record keeping, and legal functions; to maintain appropriate business records; to enforce company policies and procedures; and related to any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy, or restructuring of all or part of our business.
  • Use of aggregated or de-identified information – use of aggregated or de-identified information (i.e., information that does not personally identify you directly), or statistical information about you, including demographics data and audience segments (e.g., sports fans, sitcom enthusiasts, cord cutters, etc.), for a variety of purposes, including sharing it with third parties for their own uses, for improving their products and services for us and others, and to make ads more relevant to your interests.
  • Fulfilling any other purpose for which you give your consent.

  1. TO WHOM DO WE DISCLOSE YOUR PERSONAL INFORMATION?

 

We may disclose your personal information to the following types of third parties and as noted above in Section 4:

  • Our affiliates (i.e., companies that control, are controlled by, or are under common control with us) for the purposes described above, including for marketing purposes;
  • Our Vendors and service providers, for various purposes, including helping us provide our products, services and customer support to you;
  • Third-Party Partners, including those with which we partner to provide contests, scholarships or co-branded services, or that want to provide you with special offers or materials regarding products or services that may be of interest to you;
  • Third-party platforms, sites and services, including third-party ad networks, analytics providers, social networks, advertisers, and Internet service providers channel partners, mobile ad networks, analytics and measurement services, and others to personalize content and display advertising within our Services (including our Sites), as well as to manage our advertising on third-party sites, mobile apps, and online services. We and these third-party ad companies may use cookies, pixel tags, and other tools to collect activity information within our Services (as well as on third-party sites and services), as well as IP address, location information, device ID, cookie and advertising IDs, and other identifiers; we and these third-party ad companies use this information to provide you more relevant ads and content within our Services and on third-party sites and apps, and to evaluate the success of such ads and content;
  • Universities, colleges, professional schools, certificate and licensing programs, and other education providers, for the purposes described above, including for marketing purposes;
  • Government agencies, to the extent necessary to fulfill legal and regulatory requirements or comply with federal, state or local laws; civil, criminal or regulatory investigations;
  • Third parties, if we reasonably believe that such disclosure is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security or integrity of our Sites, services, databases and other technology assets, and business; and/or (c) to exercise or protect the rights, property, or personal safety of us, our customers, visitors, or others;
  • The public, when we post the names of scholarship or sweepstakes winners on our Sites; and
  • Third parties in the event of a transfer, sale or merger of all or part of us or our affiliates, whether through a sale, acquisition, merger, consolidation, reorganization, bankruptcy, or other corporate change involving us or our affiliates.

You can limit how we disclose your Personal Information by managing your communications preferences, exercising applicable privacy opt-out rights, or by contacting us at [email protected]. You may also opt out of marketing communications by clicking on the unsubscribe link provided in such communications. You may not opt out of transactional communications (e.g., account verification, changes/updates to features of the Sites or services, and technical and security notices).

 

  1. ONLINE TRACKING AND ADVERTISING

We collect certain usage information through a variety of tracking technologies, including cookies, Flash objects, web beacons, file information and other similar technology (collectively, “Tracking Technologies”), and we may use Vendors, including social media platforms, analytics companies, data brokers, third-party advertisers, and other technology companies that offer digital advertising services (“Third-Party Digital Businesses”), to collect information using Tracking Technologies.

Information collected using Tracking Technologies includes personal information described in the table above. We may share, or we may permit Third-Party Digital Businesses to collect personal information about your use of our Sites over time so that they may display ads that may be relevant to your interests on our Sites as well as on other websites or apps, or on other devices you may use. We or the Third-Party Digital Businesses use this information to make the advertisements you see online more relevant to your interests.

Depending on your browser or mobile device, you may be able set your browser to refuse all cookies or notify you of Tracking Technologies by actively managing the settings on your browser or mobile device (as described below). If you delete your cookies or if you set your browser or device to decline these technologies, some services may not function properly. Our Sites do not currently change the way they operate upon detection of a Do Not Track signal, but see “Global Privacy Control” in the U.S. State Privacy Notice.

You can set your browser to transmit a “global privacy control” (“GPC”) signal or another approved “universal opt-out mechanism” to opt out of targeted advertising and sales (as defined under applicable law). If we detect that your browser is transmitting a GPC or other recognized universal opt-out signal when you visit one of our Sites, we will opt that browser on your device out of non-essential cookies and pixel tags on that Site. Please note that if you come back to that Site from a different device or from a different browser on the same device, you will need to apply the signal for that browser and/or device as well.

Clear gifs help us better manage what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages or in emails and are about the size of the period at the end of this sentence. We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. We tie the information gathered by clear gifs in emails to our users’ personal information.

We and our third-party providers use cookies, clear GIFs/pixel tags, JavaScript, local storage, log files, and other mechanisms to automatically collect and record information about your browsing activities, application activity, and use of the Services. We may combine this "activity information" with other personal information we collect about you. Generally, we use this activity information to understand how our Services are used, track bugs and errors, provide and improve our Services, establish matchmaking, verify account credentials, allow logins, track sessions, prevent fraud, and protect our Services, as well as for targeted marketing and advertising, to personalize content and for analytics purposes.

 

Online Analytics

We also use various types of online analytics, including Google Analytics, a web analytics service provided by Google, Inc. (“Google”), on our Service. Google Analytics uses cookies or other tracking technologies to help us analyze how users interact with and use our services, compile reports on the related activities, and provide other services related to Site and app activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a return visitor, and any referring site or app. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google’s privacy policy. Tracking Technologies – Your Additional Choices

Preferences: We make available multiple ways for you to manage your preferences regarding targeting cookies, advertising, and personalization:

Our Sites: You can review or change your preferences for targeting cookies and tags on our Sites by adjusting your cookie settings.

Mobile: Our mobile apps may include third-party advertising and personalization. You can opt out of targeted advertising in the mobile app through the in-app settings and/or by adjusting your device privacy settings (please refer to your device settings for more information). This means that you will no longer get targeted ads in the app; however, you may still receive contextual or general ads.

You can review or change your preferences for most cookies on our Sites (other than those that are necessary to the proper functioning of our Sites) by adjusting your cookie settings.

Cookie management: You have choices about how cookies are used during your visits to our Sites. You may be presented with a banner where you can opt in to or out of certain cookie categories. You may not opt out of “strictly necessary” cookies, which ensure our Sites work properly. If you do not make any selections by either clicking the “x” to close the banner or by navigating away from the initial web page, your choices will be captured as opted out of all cookies except strictly necessary cookies. You can change your choices at any time within our Sites.

Browser Settings: In addition, you can exercise control over browser-based cookies by adjusting the settings on your browser, and mobile devices may offer ad and data limitation choices. Please note that when you use cookie control tools, you will have to change your settings for each browser and device you use, and your limitation on cookies can limit the functionality of online services you use, including our services.

In addition, your mobile device settings may allow you to prohibit mobile app platforms (such as Apple and Google) from sharing certain information obtained by automated means with mobile app developers and operators such as us.

Ad Industry Tool: Certain third parties may collect personal information in association with your use of our online services may use such information for advertising, analytics and other purposes, and may also sell that personal information downstream. Please note that you must opt out on every device and browser you use in order to effectuate your “Do Not Sell” requests from these parties. However, opting out does not mean you will stop seeing ads and you may continue to still see interest-based ads. Clearing cookies or changing settings may affect your choices described above and you may have to opt-out separately via each browser and other device you use. Cookie-enabled opt-outs signals may no longer be effective if you delete, block or clear cookies. Personalized Advertising Choices:

You can ask us to stop personalizing your ads on mobile apps by accessing any settings offered by your mobile operating system to limit ad tracking.

You can ask us to stop personalizing the ads on your device, by selecting “Limit Ad Tracking” or turning off “Personalize Ads” in your settings, depending on the settings provided on your device.

However, opting out of participating ad networks does not opt you out of being served advertising. You may continue to receive generic or "contextual" ads on our Services. You may also continue to receive targeted ads on other websites, from companies that do not participate in the above programs.

In addition, if you withdraw consent or otherwise object to our collection, use, and disclosure of your personal information, you may not be able to use the Services or Sites.

In addition, our Services and/or Sites may include or incorporate social media and other third-party features (e.g., widgets, buttons, and plugins), which are operated by third parties, such as educational institutions, Facebook, Steam, Twitch, Twitter, Instagram, YouTube, and others. These features are hosted by the respective third-party operator even though they appear on our Services or Sites, and the third party may collect your IP address, URL, date and time stamp, browser details, and the like, subject to their own privacy policies.

If you provide your Personal Information on a co-branded page, your Personal Information may be shared with the Authorized Third Party. Please review the Authorized Third Parties’ privacy policy and terms of use prior to providing any Personal Information.
